Nymph Design

The following text is the terms you are agreeing to when entering into a contract with (commissioning) Nymph Design / FaerieSaga. Please make sure you have read through them completely, and understand them. By commissioning Nymph, you are agreeing to the terms, and breaking the contract could potentially lead to blacklisting.

All Commission Types

General

❥ I am a chronically ill artist. I live my life on disability, and struggle with alot of hidden illnesses. Therefore, I cannot always guarantee a specific turn-around time, and do generally not work with deadlines.
❥ I cannot always guarantee a speedy turnaround, or even that I’ll work 5 days a week. My health dictates how much I’m able to work - please respect this.
❥ Any and all commissions I take are subject to be used in my portfolio. I do not do secret commissions, but I can delay posting your finished commission to my social media/website in the event of surprise gifts etc.❥ Although I don’t work a “normal” 9-5 job, I am not chronically online or available 24/7. I try to respond to any and all messages as soon as I am able, but please allow me 24-48 hours to respond. If I do not get back to you within 2 days, feel free to poke me again!❥ With the exception of logos and watermarks, you do not have the commercial rights to any work I produce for you, unless we have explicitly discussed this before the commission is started. These types of commissions come at an extra cost, and I rarely do them. You’re free to use your work in any way as long as you are not profiting of it, or using it as self-promotion in any way.❥ I am a slow artist. I struggle with pain and frequent burn-outs, so please be patient with me.

Payment, Currencies & Refunds

❥ As I am Norwegian, my methods for payment vary depending on your country of origin.
- For non-norwegian customers, I only accept PayPal or Boosty payments in EUR or USD.
- For Norwegian customers, I accept Vipps, direct/bank transfers, PayPal and (at conventions) card.❥ I am somewhat strict with refunds, but they are available - just not under all circumstances. They vary depending on what type of commission is placed, so please check out the refund section of either the artwork or textile section of this T.O.S.

Quotes & Pricing

✂ My pricing guide is a general guideline, and every piece is priced individually by quote. I do not take on orders without giving out an exact quote in advance, and all quotes go through my form to ensure everyone involved is aware of the cost.✂ My prices are high because of multiple factors. I use quality materials. I use multiple expensive machines. I also spend anywhere from 2 to 60 hours on each project, and I have been sewing since 2010. I am not a licenced seamstress and am mostly self-taught, but I take pride in my work and try to make sure every single piece I send out is up to the highest possible standard. No two pieces will ever be the same, and every single part of any given piece will be made with love and with heart.✂ Your quote is only good for around a week, or until we have agreed upon a payment or payment plan. I can not guarantee you get the same price the next week, month or year, as rates are subject to change. This can be increased material costs, increased shipping or import rates, or simply me adjusting my prices according to my skill-level.✂ With every commission, you will get a piece of concept art to approve of your design, before I start creating it. The concept art comes with every design for free. If you would like to see the concept in drawing before making a decision and placing an order, this is a flat rate of €35 per concept. If you do decide to go ahead with the commission after seeing the artwork, the €35 will be subtracted from the total price.✂ You are not allowed to take my concepts to another artist and ask them to do it for you. The art I provide is drawn specifically with my techniques and signatures in mind, and are not to be used by others as a “recipe”. Of course, I cannot stop you, but I do not provide concepts for others to have an easy way into what I’ve been doing for 10+ years.

Quality & Fixes

✂ I double and triple check all seams as every piece is being made. Ideally, there should be no faults. However, in the event that there is a fault in your product, I am always available to either fix the problem for free (as long as the mistake was on my end, and not something that occured during transit or use), or talk you through how to fix it on your own.✂ Should you want to send it back to me for me to fix the item, I will not cover shipping costs.✂ I do fix up items that have been damaged over time and use, but this will come at an extra cost, as it's not a problem with the initial making of the product. I've never had a garment come back for a fix, so as long as you treat the garment with care and clean as instructed by me, you will likely have your product for many years to come without issue.✂ I can never guarantee a 100% color match to your character or consept. I am for the most part at the mercy of whatever colors I can find my materials in, but will hand-dye fabrics where needed and where possible. Be aware that this costst extra.✂ Please keep in mind, that all my items are hand-made. I take extreme care to produce something as close to your wishes as possible, but there is always the possibility of human error. Additionally, most designs have to be tweaked slightly to fit in the specific format (hoodie, kigurumi, patch etc) so some artstitc liberty will always be at play. You will always get a design to approve before I start, though.

Payments & Payment Plans

✂ Payment can be made up front, or through a plan. However, the commission will not be started until full payment has been made - this includes shipping.✂ At least 25-35% of every commission will be non-refundable. This portion of the payment goes directly into ordering the fabrics, and this will not be refunded as it will push me into the negatives over a canceled commission.✂ Payment plans are done by individual agreement. They are usually okay for up to 12 months, but payments of around €100 or more are preferred per month. I am flexible with my plans, as long as you are up front with me along the way.
✂ I send invoices through PayPal, with an agreed upon minimum per payment. Your invoice will always include the price of the garment, as well as shipping and handling.

Refunds

✂ Refunds are available - but not on all commissions and at all stages of the process. I will always try to be fair, but as garment making is very time consuming, I have to be fair to myself and time spent as well.✂ The agreed upon deposit part of the commission (normally 25-35%) will never be refunded, as it’s spent on fabrics.✂ The remainder of the paid amount can be refunded, but it depends on where we are in the process of sewing. The farther along the commission is, the less you’ll be refunded if you for some reason need to cancel your order. I will provide you with proof of process in this event, and we will work something out together. All refunds will be case by case.✂ No refunds on the grounds of long wait-times will be allowed until your commission has been waiting for 3 months or more.✂ Custom work like this is a luxury. Please do not enter into a payment plan agreement (or commission at all) if you’re not sure you are financially okay to do so. Repeatedly backing out might get you blacklisted. Of course life happens, and I will always be reasonable - but I am not responsible for your financial stability.

Queue & Timeline

✂ As previously stated in this T.O.S, I am a chronically ill artist. I struggle with multiple pain-related conditions, and I have a house and family to take care of as well. I try to stick to a schedule, but some days are worse than others, and I cannot always guarantee my work days or hours.✂ Turn-around is usually between 1 and 6 months for hoodie or kigurumi commissions, but some projects might take longer. It all depends on materials, shipping/import and general workload and health. However, I try to keep my clients up to date and I work as efficiently as I can. Due to 2021-2022 being difficult, I have been backlogged on comms - but this is not the norm, and once my queue is cleared, average completion time will return to ~3 months.✂ I try to be online and responsive with my clients, and I am always transparent about my health issues. Digital Art Commissions

General

✎ My pricing guide is a general guideline, and every piece is priced individually by quote. I do not take on orders without giving out an exact quote in advance, and all quotes go through my form to ensure everyone involved is aware of the cost.✎ I have a right to post any and all finished commissions as well as any WIPs to any and all of my social media.✎ I send WIPs of the sketch, linework and flat colors. Once a step has been approved, I will move on to the next step. After a step is approved, I might not be able to go back and fix mistakes (i.e linework after flats are completed) - so please make sure you’re satisfied with the progress before giving me the go-ahead.✎ I work best with clear, unshaded references. The exception to this is portraits - for this type of commission I require a high-res, clear image or photograph. I typically don’t work off of written descriptions only, unless it’s for a custom character.✎ None of my art may be used in block chain related technology, this includes NFTs. I also don’t allow my art to be used in any form of AI generated “art”.✎ Commissioners can upload their commission to almost all social platforms - I’m on most of them. Ask for my @ so you can properly credit! As long as the image is clearly credited, you are free to post it.✎ All images I produce are copyrighted to me, Nymph Design / Faerie Saga. Clients’ characters are copyrighted to them, even if the art has been done by me.

Custom Designs & Adopts

✎ You have all rights to your design once it’s done/purchased. You may alter it as you please, as long as you credit the original art piece.✎ You may draw over my design, as long as it’s clearly labeled what is done by me and what is done by you.✎ If you get an adoptable or a custom design by me and upload them to ToyHou.se, you have to credit me (FaerieSaga) as the original characters’ creator. If you prefer, I can upload it to ToyHou.se and transfer it to you instead.✎ You may not, under any circumstance, sell a character for more than you paid for it, unless you have added artwork/other items that add to their worth.

Payment & Refunds

✎ I take PayPal or boosty for international clients, and Vipps + direct deposit for norwegian clients. If paid via Boosty or PayPal, I only accept EUR or USD.✎ Only commissions completely unstarted are eligible for a 100% refund. If a rough concept sketch has been sent out, you can only expect a 50% refund - I have already spent my time, energy and creativity on it, and will only refund the 50% if the sketch can be repurposed to another client and/or a YCH of some sort.✎ If the linework has been completed. you can only recieve a maximum 30% refund. If the colors have already been completed, you are not eligible for any refund.✎ I have the right to refund a client at any time in the process without giving a reason as to why. This includes if I do not feel comfortable working with you, or I feel like we don’t communicate well.✎ I will absolutely never refund a piece after it’s been completed. If you did not voice your concerns during any stage, I am not responsible for your dissatisfaction with the finished result.
